Batycki brand makes all necessary efforts to respect your right to privacy and to protect your personal data in accordance with current legislation. The following information provided to you will help to resolve any relevant privacy issues.
This Privacy Policy applies to your personal data as a user of the website (hereinafter referred to as "Users") operating at www.batycki.eu (hereinafter referred to as the "Service" or the "Store"), as well as other persons indicated in this Privacy Policy.
Our Privacy Policy is governed by Polish law and complies with the RODO.
Who is the controller of your personal data?
The main administrator of your personal data provided via the Website is MS sp. z o.o., which conducts its business activity and showroom in Gdańsk at 12 Litewska St. The registered office of the company is Straszyn at Jowisza No. 1 lok. 4, 83-010 Straszyn. The Company is entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Gdańsk-Północ in Gdańsk, VII Economic Division of the National Court Register under KRS no.: 0000428186, the Company's share capital amounts to PLN 100,000.00, and the Company's NIP no. is: 5213634027 (hereinafter referred to as MS).
MS sp. z o.o. together with FSI sp. z o.o. with its registered office in Straszyn at ul. Jowisza No. 1 lok. 4, 83-010 Straszyn, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Gdańsk-Północ in Gdańsk, VII Economic Division of the National Court Register under KRS no.: 0000598498, share capital amounting to 5. 000,00 PLN using NIP number: 6040168938 (hereinafter referred to as FSI) are the joint administrators of your personal data.
What does data co-management entail?
MS and FSI jointly determine the purposes and means of processing your personal data as part of the business relationship.
The joint controllers have agreed that MS will be responsible for the processing and security of the personal data processed by the joint controllers in pursuit of the joint objectives.
MS will act as the Leader vis-à-vis the processing of your personal data, which means that MS fulfils any obligations to you under data protection legislation. In order to exercise your rights under the RODO, which are described below, we recommend that you use the options available in the Customer Panel or make a request to MS. If you contact FSI this request will be forwarded to MS.

In order to identify you correctly, we ask you to provide your name, surname, telephone number and, if you are authorised to represent us, also the name of the entity on behalf of which you have acted or are acting. If you are in doubt about your identification, we may ask you to provide additional data or information.
Data Protection Officer
In order to further strengthen the protection of your personal data, the Joint Administrators have appointed a Data Protection Officer (DPO). The Data Protection Officer will answer any questions you may have regarding the protection of your privacy by the Batycki brand via the email address [email protected].
Source and scope of data processed
We collect your personal data that you have provided to us via the Website.
As part of the personal data provided to us, we may process primarily: your name, surname, delivery address, e-mail address, telephone number or the name of the company or entity you represent.
We request that you do not submit personal data more extensively than is necessary to process the matter in question or to respond to the enquiry you have made, particularly in files which may be posted as an attachment to the contact form. We reserve the right to delete such data immediately, even without contacting you first.
If you register using your Facebook account: we collect your name as it appears on your Facebook account and your identification number (Facebook ID).
If you log in using your Facebook account, we will use your name and email address from your Facebook profile to identify you as a Service User and to provide you with access to the Service.
Grounds and purposes for processing your personal data
Your personal data will be processed:
- on the basis of your consent (basis of Article 6(1)(a) RODO),
Your consent is necessary, among other things, to enable us to send you the Newsletter.
- to take action at your request in connection with the possibility of entering into a future contract with you (Article 6(1)(b) RODO),
In the event of an enquiry about a specific product range, we process your personal data in order to respond to you and enter into a future contract.
- In order to pursue our legitimate interests to contact you (basis of Article 6(1)(f) RODO),
We may contact you to provide you with information on how to deal with a particular order or to process a complaint.
- for our internal administrative purposes, including internal statistics, which are the exercise of our legitimate interest (basis of Article 6(1)(f) RODO);
We keep internal statistics in order to optimise the customer service process.
- for archival (evidential) purposes, being the realisation of our legitimate interest in securing information in the event of a legal need to prove facts (basis of Article 6(1)(f) RODO);
We store and secure personal data for possible future tax or civil proceedings.
- for the purposes of possible establishment, investigation or defence against claims being the exercise of our legitimate interest (basis of Article 6(1)(f) RODO).
We keep and secure personal data at least until the expiry of the limitation periods under civil law.
Consent
Please note that the provision of personal data is voluntary, but necessary for the use of our Service.
In the case of persons under the age of 16, consent should be given or confirmed by a parent or guardian.
Automation of processing
Your data will not be subject to automated decision-making, including profiling.
Categories of recipients of the data
Your personal data may be passed on to entities authorised by law and, to a limited extent, to entities with whom we have an ongoing relationship, such as ICT system providers, website hosting companies, law firms or courier companies delivering your ordered parcels.
We will make every effort to ensure that the extent of the information provided is always necessary and adequate for the purposes intended.
Data transfer
We will not transfer your personal data outside of the Republic of Poland.
Data storage period
We store your data for the period necessary for the performance of the contract and for the period specified in the applicable laws, but no longer than is necessary for the purposes arising from our or your legitimate interests, i.e., among other things, for the assertion of business claims. We will process the data relating to the invoice issued to you in respect of purchases made by you until the expiry of the tax liability period and the statute of limitations for possible claims or the end of the warranty period. If you have consented to the processing of your personal data for specific purposes, e.g. indicated marketing activities, your data will be stored until you withdraw your consent.
Your rights
The provisions of the RODO allow you to manage your personal data effectively. We have made it easier for you to exercise your rights by introducing the option of automatic Privacy Management in the Customer Panel (under My Account). In this way, you can, among other things:
Exercise your right of objection, i.e. review the consents you have given to us, as well as revoke some of them. Please note that consents required for the processing of orders and payments through third parties cannot be revoked. In this case, your only option is to delete your account from our shop.
Exercise your right to correct information (right of access and right of rectification), i.e. edit your addresses, your personal data, and change your password in an easy and transparent manner.
Exercise your right to data portability, i.e. download the data associated with your account that we hold in our shop, including export of order data, export of personal data and export of addresses.
Exercise your right to anonymise your data, i.e. to convert all of your data associated with your account to anonymised data other than that used by you in our shop.
To exercise your right to be forgotten, i.e. to simply delete your account from our shop. In order to continue placing orders in our shop, you will have to re-enter your data or register.
Exercise your right to be informed, by being able to read basic information about our processing of your personal data.
Exercise your right to be notified, should there be an outflow of data in our system, you should be notified within 72 hours.
Exercise your right to restrict processing if you want us to stop processing personal data linked to your account.
The recommended and fastest way to exercise your rights is to use the relevant functionalities of the Customer Panel. However, we will make every effort to fulfil your requests that are received in any other form, including paper or email.
If you submit your application in any other form, we reserve the right to verify your identity. Failure to successfully verify your identity for reasons for which you are responsible will mean that we will not process your application, of which you will be informed immediately.
Submitting a request in a form other than the Customer Panel may extend the response time to 30 days. In objectively complex cases, i.e. cases requiring a great deal of work on our part, this period may be extended to two months, of which you will be informed immediately.
Right of complaint
In justified cases, you may lodge a complaint with the supervisory authority - the President of the Office for Personal Data Protection.
Other provisions
We collect and store your personal data with due care. In the case of data processed in electronic form, it will be stored on password-protected servers and on IT systems leased by us from hosting companies and based on separate agreements (so-called data processing entrustment agreements). In the case of data processed in paper form, they will be stored in locked cabinets, in premises secured by additional access key locking and an alarm system.
Cookies and system logs
Please be informed that as soon as you connect to the Website, information about the number (including IP) and type of your terminal device from which you connect to the Website appears in the system logs of the Website. Please be informed that we will also process, in accordance with the provisions of the applicable law, data concerning the number (including IP) and type of your terminal equipment, as well as the time of your connection to the Website and other exploitation data concerning your activity. This data is processed in particular for technical purposes and to collect general statistical information.
We use cookies (i.e. small text files sent to your device that identify you in a way necessary to simplify or cancel a given operation) to collect information related to your use of the Website. Cookies make it possible: to maintain your session; to adapt the Website to your needs; to create statistics on the number of visitors to the Website.
You can change your cookie settings at any time by changing your web browser settings. These settings can be changed in particular in such a way as to block the automatic handling of cookies in the settings of your web browser or inform you each time they are placed on your device. This Privacy Policy may need to be updated from time to time, e.g. due to the introduction of new services or a change in the technology used. We reserve the right to amend or supplement the Privacy Policy at any time. Changes will be posted on www.batycki.eu
