PROMOTION TERMS AND CONDITIONS

General terms and conditions of promotions conducted in the online store batycki.eu

§ 1. General provisions

Regulations specify general terms and conditions of Promotional Actions conducted in the Internet Store www.batycki.eu.

The organizer of the Promotional Actions is: Batycki brand, operating under the name of MS sp. z o.o. with its registered office in Straszyn, Jowisza 1/4 Street 83-010, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Gdańsk-Północ in Gdańsk, VII Economic Division of the National Court Register under KRS number: 0000428186, NIP: 5213634027, REGON: 146225579.

§ 2. Definitions

Whenever the following capitalized terms are used in the Regulations, they shall be understood as follows:

Promotional Action - a promotional program being an element of marketing activities conducted by the Organizer, the purpose of which is to promote sales in the Online Store, addressed to the Participants and providing for the possibility of receiving a Prize if the Participant meets the conditions of the Promotional Action during its duration, the rules of which are set forth in the Regulations and the Detailed Rules of the Promotional Action;

Prize - a prize in the Promotional Action, which may be, in particular: Voucher, merchandise, the opportunity to purchase a given merchandise or category of merchandise with a certain amount or percentage discount, Cash Bonus. The prize in the Promotional Action is indicated each time in the Detailed Rules of the Promotional Action;

Voucher - a token with an expiration date and nominal value indicated on the Voucher, entitling the holder to make payment for goods or services in an amount corresponding to the nominal value of the Voucher. The type, issuer, expiration date and nominal value of the Voucher are indicated in the Detailed Rules of the Promotional Action each time the Reward is a Voucher;

Cash Bonus - an Award in the form of cash, in the amount of a percentage discount (rebate) calculated on the price of a specific good, granted after the conclusion of the Sales Agreement and the payment of the resulting price by the Participant, which includes the reimbursement to the Participant of a part of this price in the amount of the granted discount (rebate) under the conditions specified in the Detailed Rules of the Promotional Action, which also indicate the amount of the discount and the manner of its calculation;

Participant - a natural person with full legal capacity, a legal person or an organizational unit which is not a legal person, to which legal capacity is granted by law, who, as an Entrepreneur, has concluded a Sales Agreement with the Organizer, meets the terms of the Promotional Campaign and has expressed willingness to participate in the Promotional Campaign;

Entrepreneur - a legal person or an organizational unit which is not a legal person and to which the law grants legal capacity, conducting business or professional activity in its own name, concluding an agreement of sale with the Organizer which is directly related to its business or professional activity, as well as a natural person concluding an agreement of sale with the Organizer which is directly related to its business activity, if the content of the agreement shows that it has a professional character for it, resulting in particular from the subject of its business activity, made available on the basis of the regulations on the Central Register and Information on Business Activity;

Sales Agreement - an agreement for the sale of promoted goods within the meaning of the Civil Code Act, concluded between the Organizer and the Participant in the Online Store during the period of the Promotional Campaign;

Online Store - the Organizer's online store offering goods for sale, available on the website at www.batycki.eu.

Terms and Conditions - these general terms and conditions of promotions conducted at the online store www.batycki.eu

Detailed Rules of the Promotional Campaign - the rules of the Promotional Campaign defining in particular the Prize that can be obtained in the Promotional Campaign, the conditions for obtaining it and the manner of its issuance, as well as the duration of the Promotional Campaign;

Rules of the Online Store - the rules of the Online Store www.batycki.eu available on the website at www.batycki.eu under the "Rules" tab.

Terms used both in the singular and plural may also mean, depending on the context, the singular and plural, respectively.

 

§ 3. General principles of the Promotional Actions

The Promotional Actions are conducted exclusively in the Online Store.

Participation in the Promotional Action is conditioned on the Participant's purchase of goods, based on the Sales Contract concluded with the Organizer during the period of the Promotional Action, and on the Participant's fulfillment of the terms and conditions of the Promotional Action specified in the Regulations and the Detailed Rules of the Promotional Action.

It is a condition of participation in the Promotional Action that the Participant is not in default of any monetary payment to the Organizer as of the date of the Participant's expression of desire to participate in the Promotional Action and until the end of its duration.

The Promotional Goods are each time specified in the Detailed Rules of the Promotional Action.

The duration of the Promotional Action is each time specified in the Detailed Rules of the Promotional Action. The deadline for taking part in the Promotion Action is determined by the date of placing an order in accordance with the Regulations of the Online Store.

The prize in the Promotional Action and its type, nature and amount, as well as the date and manner of issuance of the Prize are specified each time in the Detailed Rules of the Promotional Action.
The type, issuer, expiration date and nominal value of the Voucher, as well as the rules for issuing and redeeming the Voucher, are indicated in the Detailed Rules of the Promotional Action each time the Prize is a Voucher.

The Voucher may be redeemed during the validity period of the Voucher, upon the expiration of which the right expires.

Participant may take part in the Promotional Action more than once, if each time he/she fulfills the conditions of participation in the Promotional Action specified in the Regulations and in the Detailed Rules of the Promotional Action, unless the provisions of the Detailed Rules of the Promotional Action state otherwise.

The Organizer is entitled to determine the maximum number of promotional goods that a Participant may purchase under a single Contract of Sale concluded as part of the Promotional Campaign, the maximum number of promotional goods or categories of promotional goods covered by the Promotional Campaign, or the prize pool.

Promotional Actions do not combine with each other or with other promotions, discounts or discount codes, unless otherwise provided in the Detailed Rules of the Promotional Action. This means, in particular, that the promoted goods are not "Sale" or previously discounted or otherwise discounted goods, unless otherwise specified in the detailed rules of the Promotion Action.

Participation in the Promotional Action is voluntary. By taking part in the Promotional Action, the Participant confirms that he/she has read and agrees to the rules of the Promotional Action set forth in the Regulations and in the Detailed Rules of the Promotional Action.

The prize is not exchangeable for cash or refundable.

The Participant is entitled to the contractual right of withdrawal from the Sales Contract, referred to in § 4 of the Regulations of the Online Store, with respect to the Sales Contract concluded as part of the Promotional Action.

 

§ 4. Procedure for handling complaints

Complaints related to the Promotional Action may be submitted in writing to the Organizer's registered address: MS Sp. z o.o. with its registered office in Gdańsk (80-719) at 12 Litewska Street, with the annotation "Complaint Promotional Action", or by e-mail to: reklamacje@batycki.pl.

The complaint submission should include, in particular: designation of the complainant and his/her electronic mail address (e-mail address) or correspondence address to which the response to the complaint is to be sent, description of the matter to which the complaint relates, content of the request.

The Organizer will consider and respond to the complaint without undue delay, but no later than within 30 days of receipt. The response to the complaint will be sent by the Organizer to the claimant's electronic mail address (e-mail address) or correspondence address provided in the complaint application.

 

§ 5. Exclusions

In accordance with the regulations of the batycki.eu online store, "Drama" and "Summer" promotions as well as "Voucher" codes cannot be combined or used simultaneously in a single purchase. Customers have the opportunity to use one of these promotions when making a transaction. This means that when placing an order, you can select one of the available promotions to apply to the products covered by it. "Drama" and "Summer" promotions and the so-called "Voucher" codes are promotional offers that cannot be combined to obtain potentially greater benefits. If you select one of these promotions, the other one will not be applied automatically. We recommend that you carefully read the terms and conditions of each promotion before making a purchase to choose the most advantageous offer in accordance with your individual preferences and needs.

 

§ 6. Final provisions

The rules of processing personal data of Participants who are natural persons by the Organizer are defined in the Privacy Policy available on the web page of the Online Store at www.batycki.eu in the "Privacy Policy" tab. We recommend that you familiarize yourself with the Privacy Policy.

Any matters not regulated in the Regulations or in the Detailed Rules of the Promotional Campaign shall be governed by the provisions of the Regulations of the Internet Store and relevant provisions of the law that may be applicable, in particular the provisions of the Civil Code. The Regulations of the Internet Store are available free of charge on the website of the Internet Store at www.batycki.eu in the "Regulations" tab in a form which allows obtaining, reproducing and recording the contents of the Regulations of the Internet Store by means of a teleinformatic system used by the Participant.

The Regulations are available free of charge on the website of the Online Store in the "/general_conditions_of_the_Promotional_action" tab.

The detailed Rules of the Promotional Action are made available by the Organizer on the website of the Online Store before the start of the Promotional Action.

The rules of the Promotional Action are defined in these Regulations and the Detailed Rules of the Promotional Action. Advertising and promotional materials concerning the Promotional Campaign are for information purposes only.

The Organizer reserves the right to make unilateral changes to the Regulations, in particular due to changes in the legal regulations concerning the organization of the Promotional Campaign, changes or emergence of new interpretations of commonly binding legal regulations as a result of court rulings or decisions of public administration bodies having direct influence on the rules of the Promotional Campaign, changes in the way the Promotional Campaign is carried out for technological or organizational reasons. The amendments to the Regulations shall not in any way affect the rights acquired by the Participant prior to the effective date of the amendments to the Regulations, in particular, the amendments to the Regulations shall not affect Sales Agreements concluded prior to the effective date of the amendments to the Regulations.

The Organizer will inform about the content of the changes to the Terms and Conditions by posting a message about the changes to the Terms and Conditions on the website of the Online Store, containing a summary of the changes to the Terms and Conditions and the new content of the Terms and Conditions before the changes became effective.

 

The Regulations are effective as of 03.03.2023.
